Job Summary
The Deputy Chief of Contract Services is a key leadership position within Capital Programs Support and oversees a number of groups including but not limited to Professional Services, Construction Management, Professional Services and Alternative Delivery Contracting Services, Audit & Closeout, and Change Order Management. The Deputy Chief will lead a large professional staff providing comprehensive contract actions including procurement of professional services and construction contracts, contract/changes negotiation and dispute resolution, and closeout of contracts to support the effective delivery of the MBTA's multi-billion-dollar capital program. The Deputy Chief shall be a strategic thinker and a problem solver and effectively work across the organization to continually improve business practices supporting the delivery of capital projects. The Deputy Chief and the Contract Services team are responsible for facilitating the delivery of the Authority's multi-billion-dollar Capital Investment Plan (CIP) with the goal of achieving cost-effective, timely, capital contract actions which are compliant with all state and federal laws, regulations, and requirements.
Duties & Responsibilities
The Deputy Chief of Contract Services shall be a collaborative team leader capable of establishing trusting relationships and solving problems and conflicts. The Deputy Chief is responsible for hiring, managing, and leading a team of procurement professionals, change management specialists, auditors, and support staff who, collectively are responsible for administering comprehensive capital program contract actions across the Authority. The Deputy Chief will also serve as the point person for all internal and external audits of capital contracting processes and procedures.
Responsibilities include:
- Direct the procurement and administration of professional services contracts and construction contracts, including the development of policies and standard operating procedures that impact the delivery of capital projects.
- Work closely with senior leadership and project managers to deliver the Authority's CIP through proactive administration of professional services and construction contracts. Such contract activities include procurement and selection of business partners, negotiation and execution of contracts, ongoing contract management support, change orders, and dispute resolution and closeout.
- Manage professional services contract actions through all phases of contract administration to assist in projects' on-time and within-budget completion. Professional services contract phases include Request for Qualifications; Request for Proposals; conflict of interest review and determination; shortlist; selection; negotiation; pre-audit; award; contract execution; amendments; task orders; interim and post-audits; invoicing and payment; consultant performance evaluations; and contract close-out.
- Manage construction contract actions through all phases of contract administration to assist in projects' on-time and within-budget completion. Construction contract phases include contractor pre-qualification; pre-advertisement authorization; advertisement; conflict of interest for Design-Bid-Build delivery method and Request for Qualifications, Request for Proposals, Preconstruction, Trade and Non-trade bids, Interim Guaranteed Maximum Price, and Final Guaranteed Maximum Price
- Work closely with senior leadership of delivery teams to determine the most appropriate delivery method for a capital project.
- Effectively implement all delivery methods including Design Bid Build, Design Build, and CM@Risk.
- Act as a liaison with other MBTA departments including, Capital Program Oversight, Finance, Legal, and Procurement and Logistics, and Risk Management to coordinate contract activities, as required.
- Update MBTA standard contracts to reflect best practices and ensure compliance with FTA, MGL, and other appropriate requirements.
- Assist in updating Authority protocols and SOPs and related manuals including but not limited to the Change Order Manual and the Professional Services and Construction Services Procurement Manual.
- Oversee outreach with the American Council of Engineering Companies of Massachusetts, Construction Industries of Massachusetts, the Disadvantaged Business Enterprise (DBE) Community, and other MBTA industry partners.
- Work closely with ODCR to implement the DBE process for federally funded contracts with MBTA to include all phases of the DBE process including technical assistance for goal setting, monitoring, prompt pay, and other enforcement tasks.
- Work closely with other MBTA departments to implement the DEI Program for professional services agreements and the Small Business Program for Construction.
- Function as a strategic resource and assist in proactively identifying and resolving potential issues.
- Organize and prioritize workload and be proactive in identifying contract administration needs/requirements.
- Prepare correspondence, reports, charts, and presentations utilizing Microsoft Word, Excel, Database, and PowerPoint.
- Work independently within broadly defined objectives in addressing complex tasks in a time-sensitive environment.
- Follow up on actions required while seeking guidance as necessary.
- Respond to each inquiry, whether from a customer, vendor, or co-worker in a courteous review and determination; award; contract execution; change orders; invoicing and payment; contractor performance evaluations; and contract close-out.
- Assist in the management of a workforce by ensuring the fair and consistent application and strict adherence to the rules, regulations, collective bargaining agreements (if applicable), and policies of the Authority including the EEO, Anti-Discrimination and Anti-Harassment and Anti-Retaliation policies.
- Drive a company or personal vehicle to attend off-site meetings, as required.

Minimum Requirements & Qualifications
- Bachelor's Degree from an accredited institution in Business Administration, Public Administration, Engineering, Construction Management, or a related field.
- Minimum Twelve (12) years of experience in procurement and administration of professional services agreements and construction contracts
- Knowledge of design and construction contracts, public procurement regulations, contract laws, and construction management.
- Minimum Seven (7) years of related experience in a supervisory capacity
- Demonstrated success managing staff in the performance of consultant and/or construction contract actions.
- Demonstrated success in developing subordinates through effective leadership and setting realistic but challenging goals.
- Strong database management skills.
- Effective written and verbal communication, organizational, analytical, time management, and interpersonal skills.
- Working knowledge of Microsoft Word, Excel, Database, and PowerPoint applications.
- Proven track record of collaboration, transparency, and problem-solving skills.
- The ability to effectively communicate with customers, employees, and vendors.
- Excellent customer service and conflict resolution skills.
- Drive a company or personal vehicle to attend off-site meetings, as required.
Preferred Experience and Required Skills
- Law Degree
- Experience in developing standard contract documents and negotiations and dispute resolution.
Substitutions Include
- A Master's degree in a related subject substitute for two (2) years of general experience.
- A nationally recognized certification, or statewide/professional certification in a related field substitutes for one (1) year of experience.
